PITTSTON — City police arrested a 22-year-old man after a woman claimed he sexually assaulted her while she was sleeping.
Nicholas Disbrow, 22, allegedly told police he had sex with the woman without her consent, describing it as watching a movie through his own eyes, according to arrest papers.
Police said the alleged assault occurred in Disbrow’s apartment on Market Street sometime late Monday night into Tuesday morning.
The woman was treated at a Geisinger Medical Facility on North Main Street and a sexual assault examination was completed at Commonwealth Health Wilkes-Barre General Hospital.
According to the criminal complaint:
The woman told police she was in Disbrow’s apartment Monday night talking about random topics. At one point, she told Disbrow her lower back was hurting and he offered to give her a massage.
She claimed Disbrow massaged her for about 30 minutes before she fell asleep.
When she woke up sometime between 8 a.m. and 9 a.m. Tuesday, she noticed the bottom half of her clothing was at the foot of the bed. She did not remember the alleged incident but claimed Disbrow had penetrated her, the complaint says.
She told police Disbrow wanted to talk and asked her if she remembered anything. He told her his feelings were hurt when she told him she did not remember.
In an interview with police, Disbrow claimed he massaged the woman’s back and legs before falling asleep. He woke up with the woman’s head on his shoulders and became aroused thinking about giving her a massage the night before, the complaint says.
Disbrow allegedly told police he removed the woman’s pants and underwear and sexually assaulted her, explaining it felt like watching a movie through his own eyes. He claimed he told himself to stop and felt guilty because the woman was going to hate him.
Disbrow was charged with aggravated indecent assault, sexual assault and indecent assault. He was arraigned by District Judge Alexandra Kokura Kravitz in Pittston and released on $25,000 unsecured bail.
